Terms & Conditions

By accessing or using EduTrak ("the Platform", "we", "us", "our"), you ("User", "School", "you") agree to be bound by these Terms and Conditions. If you are entering into these terms on behalf of a school or organisation, you represent that you have the authority to bind that entity. If you do not agree to these terms, do not use EduTrak.

EduTrak is a cloud-based school management platform that enables schools to manage students, classrooms, attendance, grades, and parent communications. We offer the Platform on a subscription basis. Features vary by plan as described on our Pricing page. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

To use EduTrak, school administrators must register for an account. You agree to: (a) provide accurate and complete registration information; (b) maintain the security of your account credentials; (c) notify us immediately of any unauthorised access; (d) be responsible for all activity under your account. Accounts may not be shared between schools or organisations without our written consent.

You agree not to use EduTrak to: (a) violate any applicable law or regulation; (b) upload or transmit harmful, offensive, or illegal content; (c) attempt to gain unauthorised access to any part of the Platform; (d) engage in data scraping, automated access, or reverse engineering; (e) use the Platform in any way that could damage, disable, or impair its operation; (f) resell or sub-license the Platform without our written consent. We reserve the right to terminate accounts that violate these restrictions.

Schools are responsible for obtaining all necessary consents to upload student data to EduTrak in compliance with applicable education and privacy laws (including FERPA, GDPR, and equivalent legislation). EduTrak processes student data solely as a data processor acting on the school's instructions. The school remains the data controller. We will never use student data for advertising, marketing, or any purpose beyond delivering the Platform services. See our Privacy Policy for full details.

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as described in our Refund Policy. We may change our pricing with 30 days' notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing. Overdue accounts may be suspended after 14 days. We accept payment by credit card, bank transfer, and mobile money (Ghana/West Africa).

EduTrak and all associated software, design, content, and trademarks are owned by or licensed to EduTrak Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for your school's internal purposes. You retain ownership of all data you upload to EduTrak. You grant us a limited licence to process that data solely to provide the Platform services.

To the maximum extent permitted by law, EduTrak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the 12 months preceding the claim. Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not apply to you.

Either party may terminate these terms at any time. You may cancel your subscription via your account settings. Upon termination: (a) your access to the Platform will cease at the end of the current billing period; (b) you may export your data within 30 days of termination; (c) after 30 days, your data will be permanently deleted. We may terminate your account immediately if you breach these terms.

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ghana. For users in the EU/UK, nothing in these terms affects your statutory rights under applicable consumer protection law.

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. The current version of these Terms is always available at edutrak.io/terms.
